PUBLIC NOTICE
Allen's Branch Community
The Town of Sylva Board of Commissioners shall conduct an informational meeting with the Allen's Branch community on August 7, 2006, at 7:00 PM in the Community Services Building located at 538 Scotts Creek Road. The purpose of the meeting is to provide information concerning Sylva's proposal to establish extraterritorial jurisdiction of the Allen's Branch area. Extraterritorial Jurisdiction or ETJ is a land use management tool a municipality may exercise within close proximity to its boundary to ensure projected development in the area is orderly and sustainable. The meeting will provide an opportunity for concerned parties to address the Board of Commissioners with questions and concerns. The meeting is primarily for the Allen's Branch area community but the general public is welcomed. A preview of the proposal for ETJ of the Allen's Branch area is on display at Town Hall, 83 Allen Street.

TAKE NOTICE that a Summons and Complaint seeking relief against you were filed March 10, 2006 in the Superior Court of Wake County, North Carolina by the North Carolina Licensing Board for General Contractors, Plaintiff, v. Countryside Logs Homes and Ashton Development Corporation, Alexander R. Czipulis, Harvey Cecil Stubbs and Christine Serenci, Defendants, and assigned case number 06 CVS 003490. The nature of the Complaint is to enjoin you from further practice of general contracting in violation of N.C.G.S. § 87-1 in the State of North Carolina until such time, if ever, when you are properly licensed to do so, and the Prayer is that the costs of this action be taxed against you.

Under and by virtue of a Power of Sale contained in that certain Deed of Trust executed by KEVIN PENNINGTON, A MARRIED MAN AND LAURA PENNINGTON a/k/a L.S. DODSON PENNINGTON, A MARRIED WOMAN to Heather C. Baker, Trustee(s), which was dated July 8, 2004 and recorded on July 14, 2004 in Book 1435 at Page 421, Jackson County Registry, North Carolina.

A cash deposit (no personal checks) of five percent (5%) of the purchase price, or Seven Hundred Fifty Dollars ($750.00), whichever is greater, will be required at the time of the sale. If the trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. Reasons of such inability to convey include, but are not limited to, the filing of a bankruptcy petition prior to the confirmation of the sale and reinstatement of the loan without the knowledge of the trustee. If the validity of the sale is challenged by any party, the trustee, in their sole discretion, if they believe the challenge to have merit, may declare the sale to be void and return the deposit.
